Terms of Service
Effective date: July 13, 2026
These Terms of Service (“Terms”) are a binding agreement between you and Evan Saksa, an individual doing business as ZipList(“ZipList,” “we,” “us”), which operates the ZipList service at getziplist.com and related applications (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What ZipList does
ZipList is a tool that helps resellers create listings once and cross-post, manage, and delist them across third-party marketplaces (including Depop, Grailed, Poshmark, Mercari, Vinted, and eBay), and run related business tasks (inventory, pricing, analytics, sale detection). ZipList is an independent product. It is not affiliated with, endorsed by, or sponsored by any marketplace, and marketplace names and logos belong to their respective owners.
2. Eligibility & your account
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate account information and keep your credentials secure.
- You are responsible for all activity under your account.
3. Marketplace connections & automation (important)
To operate the Service you may connect your third-party marketplace accounts. By connecting an account you authorize ZipList to act on your behalf on that marketplace — for example to log in, create and edit listings, upload photos, adjust prices, import your existing listings, and delist items — using the credentials or authenticated sessions you provide.
- You are solely responsible for complying with each marketplace’s own terms, policies, and rules. Automating activity may be restricted by some marketplaces; you are responsible for how you use the Service in relation to your marketplace accounts, and for any consequences (including account restrictions) that result.
- Marketplaces change frequently and may alter or block automated access at any time. We do not guarantee that any connection, post, import, or delist will succeed, complete on time, or continue to work.
- You remain responsible for your listings, prices, orders, fulfillment, taxes, and customer obligations. ZipList is a tool; it does not sell your items or act as a party to your sales.
- Automated browsing may route through third-party proxy infrastructure to connect to marketplaces on your behalf; see the Privacy Policy.
4. Credentials & content
You grant us permission to store and use your marketplace credentials and session data solely to provide the Service. Credentials are stored encrypted and are used only to operate the connections you set up. You may disconnect a marketplace or delete your account at any time, which removes the associated credentials. You retain ownership of the listing content, photos, and business data you provide; you grant us a license to host, process, and transmit that content as needed to provide the Service (including sending it to the marketplaces you connect and to the AI provider used for auto-fill).
5. Acceptable use
- Do not use the Service to list or sell unlawful, counterfeit, stolen, or prohibited items.
- Do not use the Service to violate any law or any marketplace’s terms.
- Do not attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
- Do not use the Service for another person’s marketplace accounts without authority.
6. Plans, fees & billing
Paid plans are billed on a recurring subscription basis through our payment processor, Stripe. By subscribing you authorize recurring charges to your payment method until you cancel. Subscriptions auto-reneweach billing period. You can cancel at any time from your account’s billing portal; cancellation takes effect at the end of the current paid period. Except where required by law, fees are non-refundable. Prices and plan features may change on prospective notice.
7. Service “as is” — no warranty
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any automated action will achieve a particular result.
8. Limitation of liability
To the maximum extent permitted by law, ZipList and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, or for marketplace account actions taken against you. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three (3) months before the claim.
9. Indemnification
You agree to indemnify and hold ZipList harmless from claims and expenses arising out of your use of the Service, your content, your marketplace activity, or your breach of these Terms.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or if required to protect the Service or comply with law. On termination, your right to use the Service ends and your data is handled as described in the Privacy Policy.
11. Changes to these Terms
We may update these Terms. Material changes will be posted here with an updated effective date, and continued use after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-laws rules. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Minnesota, and you consent to their jurisdiction and venue.
